Law Express - Terms & Conditions Agreement (1)

This Service is provided by Law Express Limited, a company registered in England and Wales under company number 04008649.

These terms and conditions (along with any documents referred to in them) sets out the terms by which you use our Service. Your payment for this Service indicates that you agree to all such terms, conditions and disclaimers. You should make sure you carefully read the relevant terms and conditions before using our Service.

Unless stated otherwise, amendments will be effective at time of posting, but will not affect your rights or obligations in respect of any Service you have purchased previously.

1. Definitions

'YOU' means the legal person entering this Agreement (whether an individual, a company or any other legal entity) and includes anyone reasonably appearing to us to be acting with your authority or permission.

'WE/US' means Law Express Limited whose address is as stated below.

'SERVICE' means the provision of telephone legal advice on a per calls basis on employment law issues according to the law of England and Wales.

2. The Service

Legal advice provided by this Service is according to the law in England and Wales.

(i) You can submit your question at any time, but advice under the Service will be provided between 9 am and 6 pm Monday to Friday and is provided on a call back basis. Within these hours we will return your call, usually within two hours of your request for advice being received or at some other time which may be reasonably agreed.

(ii) Whilst no time limit is set on the duration of a telephone advice call, the Service is nonetheless provided on a reasonable use basis and we reserve the right to limit the length of any advice call which is considered to be excessive.

(iii) The Service is provided by experienced advisers employed by Law Express. All advisers have a law degree and some are also former practising solicitors. All have significant experience in providing employment law advice.

(iv) All advice calls will be recorded for training and monitoring purposes.

(v) Due to the complex nature of litigation, it is not possible to provide advice on matters where proceedings have already started in the Courts or Employment Tribunal.

(vi) If we determine, in our sole discretion, that due to the unusual or complex points of law revealed, the Service is not relevant or appropriate, we will advise you accordingly and refund any charges.

(vii) Law Express is not a law firm, is not regulated by the SRA and the Service is not provided by practising lawyers. Information and guidance provided as part of the Service does not create a lawyer-client relationship between You and Us.

3. Disclaimers and Limited Warranty for Service

The provision of the Service will be subject to the conditions described herein and do not affect your statutory rights.

(i) The Service

We accept no responsibility for any information that you provide, including any inaccuracies or any failure by you to provide necessary and relevant information required in connection with your request for the Service and all advice, guidance and information rendered can only be based upon information disclosed by you.

(ii) After Sales Service

(iii) Exclusion of Liability

We will not be liable to you in contract, tort (including negligence) or otherwise for any indirect, consequential, special or incidental damage or loss arising from the Service including (without limitation) loss of business or profits or anticipated savings.

Nothing in this Agreement shall limit or exclude a party's liability for death or personal injury caused by negligence, or fraud.

(iv) Limited Warranty

Subject to the foregoing, we represent and warrant that we will use reasonable efforts to employ only suitably qualified personnel in the delivery of the Service.

4. Data Protection

(i) Your right to privacy is respected and we will treat all information relating to you in accordance with our Privacy Policy and Data Protection legislation as laid down and will ensure that your personal information is stored securely and will not provide it to any third parties.

(ii) By agreeing to this Agreement, you are consenting to the following:

a) We or any parties acting on our behalf, must store, host, transfer and otherwise process your information as described herein and you explicitly consent to us handling your personal information.

b) Personal information that you supply may include sensitive information relating to religious or political beliefs, sexual orientation preferences, union membership or other matters etc and you again explicitly consent to us processing and handling such information accordingly.

c) We will only disclose your personal information if we are under a duty to disclose or share your personal data in order to comply with a legal obligation, or to enforce or apply our terms of use.

d) Atom Content Marketing Ltd, which owns the Law Donut website, will review your information to analyse the effectiveness of the content on the website.

5. Cancellation

(i) If you are unhappy with the Service for any reason and request a refund within 14 days of payment for the Service, we will refund you. Notice to cancel should be sent to the address below.

(ii) You also have a statutory right to cancel this Agreement within 14 days of payment for the Service except when the Service has been provided during that period.

7. Jurisdiction

This Agreement shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.
