Freelance Sales Person

As a sole trader, I am considering using the services of a freelance sales person. Could you please tell me if there are any legalities I should be aware of? Also, he has asked me to provide him with a mobile phone, but i am concerned about doing this for a number of reasons not least that it may constitute employment in some way. Would I have to get him to sign an agreement between us before giving him any sales information?
Any information you could provide would be gratefully received.
